AG Yes On Denying Deschutes Carte Blanc Access To OMMP

Sheriff L. Shane Nelson

Based on a request of OHA by Deschutes County Sheriff’s office and DA for a complete list of all OMMP grow sites in their county, the OHA recently asked the AG’s office for an opinion on the issue of disclosing carte blanche the addresses of OMMP grow sites.

The AG has concluded that the OHA is within statutory right to deny law enforcement access to complete lists of grow site addresses within their jurisdictions and upheld the confidentiality of the OMMP registry and OHA’s right to refuse the Sheriff’s request and provide this information only if a particular grow site, patient or caregiver are registered with the OHA and law enforcement cannot call in with a list for verification.

“ORS 475B.822(1)(b) makes grow site addresses, patient cardholder names, and primary caregiver names confidential.”
